Terms of Service

These Terms of Service ("Terms") govern your access to and use of KyberCrypt's post-quantum encrypted file-transfer service, available at kybercrypt.com and related applications and APIs (the "Service"). By creating an account or using the Service you agree to these Terms. If you are using the Service on behalf of an organization, you represent that you are authorized to bind that organization.
1. The Service
The Service lets you encrypt, send, request, and store files and messages. Content is sealed with hybrid post-quantum cryptography (ML-KEM-768 combined with X25519) and AES-256-GCM. Availability, features, and limits depend on your plan and may change over time.
2. Accounts and security
You are responsible for your account credentials and for all activity under your account. Your account's private key is encrypted with a key derived from your password in your browser; if you lose your password, your data cannot be recovered by us. We recommend enabling two-factor authentication. Notify us promptly of any unauthorized use.
3. Acceptable use
Your use of the Service must comply with our Acceptable Use Policy, which is incorporated into these Terms. We may suspend or terminate accounts that violate it.
4. Your content
You retain all rights to the files and messages you transmit or store ("Your Content"). You grant us only the limited rights necessary to operate the Service — storing and transmitting encrypted content, and, where you enable it, processing it transiently to provide requested features (see the Privacy Policy and Security page). You are solely responsible for Your Content and for having the rights to transmit it.
5. Fees
Paid plans are billed in advance through our payment processor (see Subprocessors). Fees are non-refundable except where required by law. We may change pricing prospectively with notice.
6. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, express or implied, to the maximum extent permitted by law. We do not warrant that the Service will be uninterrupted, error-free, or that data will never be lost. You are responsible for maintaining your own backups of important content.
7. Limitation of liability
To the maximum extent permitted by law, KyberCrypt will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or data. Our aggregate liability arising out of or relating to the Service will not exceed the amounts you paid us in the twelve months preceding the claim.
8. Termination
You may stop using the Service at any time. We may suspend or terminate access for violation of these Terms or to comply with law. On termination, content is deleted in accordance with our Data Retention Policy.
9. Changes
We may update these Terms. Material changes will be posted here with a revised "last updated" date; continued use after changes take effect constitutes acceptance.
10. Governing law and contact
